1. Services & Results
We offer advertising and marketing services tailored to each client. While we aim to drive results, we do not guarantee specific outcomes, such as lead count, revenue, or appointments booked. Results depend on factors beyond our control, including client responsiveness, market demand, and ad platform policies.
2. Client Responsibilities
Clients are responsible for:
Providing accurate business info, logos, and access credentials
Responding to leads delivered via text or email in a timely manner
Approving creative materials or campaign elements within 2 business days
Notifying us of any changes to offers or disruptions to communication channels
Failure to meet these responsibilities may impact performance and void any rebuild offers.
3. Payment Terms
Payment is due upfront before any work begins. No refunds will be issued once services are initiated. For multi-month plans, full payment must be received before launch.
4. No Refunds Policy
All sales are final. Payments cover access to our time, systems, creative labor, and reserved capacity. We do not issue refunds for unused time, paused campaigns, or dissatisfaction based on subjective results. A rebuild may be offered at our discretion, provided the client met all onboarding and communication requirements.
5. Intellectual Property
All creative assets, landing pages, and ad systems created by Zenith Web remain our property unless otherwise agreed in writing. Clients receive a limited-use license for the term of the contract. Landing pages will be deactivated within 5 business days of contract expiration unless renewed or purchased separately.
6. Confidentiality
Both parties agree not to disclose or use confidential information for any purpose outside the scope of the agreement. This includes campaign data, business information, and marketing strategy. These obligations survive termination of the relationship for 2 years.
7. Limitation of Liability
We are not liable for:
Account suspensions by Meta or other ad platforms
Missed or unconverted leads due to client inaction
Indirect, incidental, or consequential damages
Our total liability will never exceed the fees paid by the client under the current agreement.
8. Governing Law
These terms are governed by the laws of the State of California. Any disputes will be handled in the courts of that jurisdiction.
